China’s Justice System Expands onto U.S. Soil, Raising Concerns Over Sovereignty and National Security

A recent investigation by reporters with the Daily Caller reveals that China is actively imposing its justice system on American soil through a network of U.S.-based nonprofits linked to a Chinese Communist Party (CCP) intelligence agency. The operation, which spans across multiple U.S. states including California, New York, Hawaii, and the Washington, D.C. area, involves the sharing of sensitive information with Chinese law enforcement and, in some cases, operating clandestine courtrooms in the U.S.

The Chinese government maintains that its overseas law enforcement efforts, which include appointments of law officials to mediate common matters like Chinese driver’s license renewals or international divorces, are benign. However, U.S. lawmakers and intelligence experts express concerns that these underground courts could be used to target dissidents and extend communist influence internationally.

The web of nonprofits tied to China’s United Front Work Department (UFWD) spans across the U.S. These organizations often act as intermediaries between Chinese law enforcement and overseas Chinese communities, helping facilitate remote legal services, including mediation and notarization. Some groups also provide physical spaces for virtual court hearings and serve as advocates for Chinese nationals in the U.S.

For instance, a 2022 announcement from the UFWD highlighted the role of an individual from the San Francisco-based World Youth Congress of Jiangmen, who was named as an “overseas mediator” for a court in Guangdong province. This individual was involved in mediating international divorce cases via video call, showcasing the expansion of China’s legal reach beyond its borders.

Additionally, similar appointments were made in Los Angeles and New York, where individuals tied to organizations like the Wenzhou Chamber of Commerce and the Fukien Benevolent Association of America were designated as overseas mediators or hearing officers. These appointments are part of a real, active initiative by Chinese law enforcement to establish a “dual justice system” in the U.S., parallel to the American legal system.

National Security Concerns

Experts warn that these efforts to establish underground courts and extend China’s legal system internationally pose significant national security risks. Ina Mitchell, a Chinese intelligence expert, explains that these civic organizations, all operating under the supervision of Chinese consulates, could easily be coerced into spying and engaging in illegal activities. Dr. Lawrence Sellin, a national security expert, warns that the CCP uses such networks to maintain control over overseas Chinese populations, monitoring their activities and punishing those who dissent against the regime.

Sellin adds, “In reality, they are means by which the CCP can monitor and, when needed, punish members of the Chinese diaspora if they deviate from the CCP agenda.” This control enables China to use Chinese community members as unwitting “foot soldiers” in espionage operations.

The investigation also uncovered a troubling trend of Chinese law enforcement officials operating within U.S.-based nonprofits, blurring the lines between civil society and state control. One individual, who holds leadership positions in both the U.S.-Zhejiang General Chamber of Commerce and the Wenzhou Chamber of Commerce Greater Washington, has been found to have close ties to China’s Ministry of Public Security (MPS). He not only serves as a mediator for the Wenzhou People’s Court but also works directly with MPS officials to oversee Chinese police operations overseas.

Other individuals identified in the report have served in various roles for the MPS, with some having previously been part of CCP paramilitary organizations. This web of connections between Chinese law enforcement and U.S. nonprofit leaders raises alarms about China’s growing influence within the U.S. and its efforts to create a “dual justice system” that operates alongside the American legal framework.

Covert Meetings and “Tea Parties”

The investigation also sheds light on a series of meetings, euphemistically referred to as “tea parties,” between Chinese officials and leaders of U.S.-based Chinese organizations. These meetings, often held in Chinese cities such as Fuqing and Fuzhou, are used to discuss cooperation between Chinese police and overseas Chinese communities. In many cases, the topics of these meetings extend to controversial matters such as the forced repatriation of Chinese nationals, sometimes using illegal means to coerce individuals into returning to China against their will.

One such meeting, attended by the secretary general of the American Fuqing Association in Elmhurst, New York, was held in February 2022, where officials from the MPS discussed their overseas police stations, which have been part of China’s “Overseas 110” network. This network, which had established 38 overseas police stations by 2022, aims to track Chinese nationals living abroad and exert control over them.

Human rights organizations have raised concerns about these “persuasion to return” operations, which often involve intimidation tactics or illegal measures to force individuals to leave foreign countries and return to China.

In response to these findings, U.S. lawmakers are sounding the alarm about China’s growing influence within American borders. Michigan Rep. John Moolenaar, chairman of the House Select Committee on the CCP, condemned the actions, stating, “The Chinese government’s attempt to impose its repressive legal system on U.S. soil through the CCP’s United Front network is an unacceptable assault on U.S. sovereignty and the rule of law.”

Moolenaar emphasizes the need for continued vigilance from both Congress and law enforcement to ensure that these illicit activities are curbed and that those involved in undermining U.S. sovereignty are held accountable.

According to Gordon Chang, a noted China expert, the Chinese Communist Party views its authority as divinely ordained, giving it the obligation to extend its control globally. He warns that any interaction between China and the U.S. presents a threat to U.S. sovereignty, highlighting that there are “no innocent contacts” when it comes to the CCP’s reach.
