In a scorching five-page letter to U.S. Attorney General Pam Bondi, New York Attorney General Letitia James’ legal team tore into the Trump administration’s recent criminal referral, dismissing it as a baseless attack rooted in “cherry-picked” information.

The accusations, leveled by Federal Housing Finance Agency Director William Pulte, claim James engaged in mortgage fraud—a charge her attorney, Abbe David Lowell, called a hypocritical jab in President Trump’s ongoing “revenge tour” against James.

The referral, described by Lowell as relying on flimsy media reports and a skewed interpretation of public records, centers on two key allegations. First, it points to a 2023 power of attorney document in which James authorized the purchase of a Virginia property, stating, “I hereby declare I intend to occupy this property as my principal residence.”

The home, located over 300 miles from her New York City office, was listed as her primary residence—an apparent contradiction.

Lowell, however, brushed this off as a simple clerical mistake, accusing Pulte of deliberately ignoring a clear statement James made to a mortgage loan broker just two weeks earlier: “[t]his property WILL NOT be my primary residence.”

The second claim targets a Brooklyn building James has owned since 2001. Pulte alleged that James, whose annual salary is $220,000, misrepresented the property as having four units when New York City Department of Buildings records list it as having five.

This distinction matters, as buildings with four or fewer units qualify for more favorable mortgage terms. Lowell countered this accusation with vigor, noting that the property has operated as a four-unit residence for the past 24 years.

He pointed to a 2011 Home Affordable Modification Program application that confirms the building’s four-unit status, accusing Pulte of clinging to an outdated 24-year-old certificate of occupancy to prop up his case.

Lowell’s letter frames the referral as a politically motivated strike, part of Trump’s promised “retribution” against his adversaries. James has long been a target of Trump’s frustration, particularly after she spearheaded a civil fraud trial against him and his Trump Organization, which culminated in a staggering $454 million judgment.

“Look at the entire file of each event, the haste in which one document has one line filled out in error, and the clear fact that, with the exception of attending school, Attorney General James has only lived in Brooklyn,” Lowell wrote.

He argued that the referral amounts to “three pages of stale, threadbare allegations” driven by media reports and Trump’s vendetta, lacking any substance to justify further action.

Adding to the controversy, Lowell’s legal fees will reportedly be covered by New York taxpayers, as he was hired by the attorney general’s office rather than James personally, according to the Times Union.

The office justified this decision by arguing that the referral stems from Trump’s personal grudge against James for her role in the civil fraud case.

Lowell, a seasoned attorney who previously represented Hunter Biden in his special counsel probe involving gun and tax charges, brings a high-profile presence to James’ defense.

As the clash between James and the Trump administration intensifies, the attorney general’s team remains steadfast, casting the referral as a desperate attempt to tarnish her reputation.

For now, the battle lines are drawn, with Lowell’s blistering response signaling that James won’t back down without a fight.
