Paxton Targets O’Rourke’s Arrest in Fundraising Feud
A fierce political battle is unfolding in Texas, where Republican Attorney General Ken Paxton is pushing for the arrest of Democrat Robert Francis “Beto” O’Rourke, accusing him of defying a court order by continuing to raise funds for a group of Texas Democrats who fled the state to block a Republican-backed Congressional redistricting plan.
Paxton alleges that O’Rourke is “blatantly” violating a temporary restraining order issued last week by Tarrant County District Court Judge Megan Fahey. The order barred O’Rourke and his political organization, Powered by People, from funding the 50 Democratic legislators who left Texas to stall a vote on a GOP-proposed Congressional map.
According to Paxton, O’Rourke flouted the ruling almost immediately, addressing a crowd of supporters and pledging to keep fundraising for the absent Democrats.
O’Rourke reportedly rallied the crowd to ignore restrictions, declaring, “f*** the rules” and “win whatever it takes.” He also urged Democrat-led states to redraw Congressional maps to counter Republican gains, as reported by The Daily Wire.
In a press release, Paxton condemned O’Rourke’s actions as a direct challenge to the rule of law. “There is a referee—the Honorable Megan Fahey—and there are rules—namely, that a person violating a temporary restraining order can be fined up to $500 and jailed for up to six months,” Paxton stated.
Pointing to O’Rourke’s “vulgar disdain for the rule of law” and substantial personal wealth, Paxton argued that jail time is essential to enforce the court’s order.
“Beto told me to ‘come and take,’ so I did and beat him in court. Now, he still thinks he’s above the law, so I’m working to put him behind bars,” Paxton added.

O’Rourke didn’t hold back, responding on X with a sharp rebuke, accusing Paxton of “lying about me to try to silence us.” He claimed the Attorney General’s office misrepresented facts in its legal filings and vowed to seek “maximum sanctions” against Paxton for what he described as an abuse of power. “Taking the fight directly to this corrupt, lying thug,” O’Rourke declared, signaling his readiness to confront Paxton head-on.
The dispute traces back to Paxton’s investigation into Powered by People after reports emerged that the group was bankrolling the Texas Democrats’ stay in Illinois, where they fled to derail the redistricting vote.
The absent legislators face daily $500 fines and are covering their living expenses while away. Powered by People, dedicated to rallying volunteers to secure Democratic wins in “competitive Texas battleground districts,” aims to reshape the state’s electorate for the long haul, beyond any single campaign.
The Democratic lawmakers, still out of state, have ignored a return deadline set by Texas House Speaker Dustin Burrows last Friday. Their absence has stretched past the 30-day special session, prompting Texas Republican Governor Greg Abbott to double down.
“I’m authorized to call a special session every 30 days. It lasts 30 days. And as soon as this one is over, I’m gonna call another one, then another one, then another one, then another one,” Abbott said on Sunday.
He warned that returning Democrats would be arrested and brought to the state capitol, adding, “If they want to evade that arrest, they’re gonna have to stay outside of the state of Texas for literally years. They might as well just start voting in California or voting in Illinois, wherever they may be.”
With O’Rourke and Paxton locked in a bitter struggle, the fallout from this legal and political saga could shape the state’s electoral future for years to come.
