America First Legal Sues Maricopa County Over Voter Roll Maintenance
America First Legal (AFL), a Washington, D.C.-based organization led by former Trump administration senior advisor Stephen Miller, has filed a lawsuit against Maricopa County, Arizona. The lawsuit, directed at Maricopa County Recorder Stephen Richer, alleges that the county has failed to comply with state laws requiring the removal of noncitizens from voter rolls.
According to court documents obtained by the Daily Caller News Foundation, AFL’s legal action follows a series of demand letters sent to all fifteen counties in Arizona last month. These letters insisted that county election officials prevent noncitizens from voting, warning of legal consequences for noncompliance. Stephen Richer, through his attorney, responded that his office was already verifying voter citizenship and would not take further action. AFL, however, disputes this claim, asserting that the number of registered voters without confirmed citizenship in Maricopa County is increasing.
Stephen Miller emphasized AFL’s commitment to election integrity in a statement to the DCNF, saying, “America First Legal is leading the charge to keep illegal aliens from voting in 2024. Maricopa County, in direct violation of state law, is refusing to remove illegal alien voters from the rolls. We are taking decisive action: suing Maricopa County for unlawfully permitting illegal aliens and foreign citizens to interfere in the 2024 election.”
Arizona law mandates proof of citizenship for voter registration, though a Supreme Court ruling restricts states from imposing additional voter registration requirements beyond federal forms, which only require a checkbox affirming U.S. citizenship. Consequently, individuals who do not provide proof of citizenship can vote in federal but not state or local elections in Arizona. AFL’s lawsuit claims that Richer is not fulfilling the state’s requirement for monthly voter roll maintenance to confirm the citizenship of federally registered voters.
James Rogers, AFL’s legal senior counsel, questioned the integrity of Arizona’s election process, stating, “How can Arizonans have confidence in the integrity of their State’s elections when the government officials in charge of administering that election are not even following the law? This lawsuit is about helping to restore the public’s trust by making sure that election officials follow the law and that foreigners are not able to influence the outcome of our elections.”
The AFL lawsuit highlights a deepening divide between Republicans and Democrats over the participation of noncitizens in U.S. elections. President Joe Biden publicly opposed legislation aimed at strengthening election integrity, specifically Texas GOP Rep. Chip Roy’s Safeguard American Voter Eligibility Act, in a statement released in July.
This lawsuit was filed on behalf of the Strong Communities Foundation of Arizona and Yvonne Cahill, a naturalized citizen and registered voter.
Potential Voter Fraud On Everyone’s Mind
Many Americans have growing concerns that there are security holes in our election systems that could be exploited for fraud, specifically issues like unclean voter rolls and voting stations with lacking identification requirements.

The fact that there’s still questions in the minds of Americans to this day about the 2020 Arizona election integrity just goes to show you how little trust there is that our election systems are bullet-proof.
With so many avenues to vote with mail-in voting, paper ballots, electronic ballots, and more, it’s a logistical nightmare to count votes properly and in a scientific way. A true indicator of a free and fair election would be the ability to produce the same count over and over again no matter how many times you count.
The fact that this can’t be done is a problem for millions of Americans. It’s an indication that the scientific method needs to be applied better to our election systems in order to make them 100% trustworthy in the eyes of all Americans.
