NSC to File Lawsuit Against New Department of Government Efficiency Over Advisory Committee Violations

A nonprofit public interest law firm, National Security Counselors (NSC), is preparing to file a lawsuit against the newly established Department of Government Efficiency (DOGE) on Monday. The lawsuit, set to be filed in the afternoon, alleges that DOGE, a cost-cutting advisory organization led by Elon Musk, violates an important law that governs the operation of executive branch advisory committees.

NSC, which has been critical of both President-elect Donald Trump and Elon Musk in the aftermath of the 2024 election, is challenging DOGE’s compliance with the Federal Advisory Committee Act (FACA). This 1972 law sets regulations on issues such as disclosure, hiring practices, and the organization of advisory committees within the executive branch. According to NSC, DOGE is a “federal advisory committee” under FACA’s definition, and therefore, must adhere to several specific requirements.

These include keeping records of meetings, ensuring balanced representation among its personnel, and submitting a formal charter to Congress. As of now, DOGE has failed to meet these stipulations, as reported by The Washington Post, which was the first to break the story of NSC’s impending lawsuit. “This is not about sour grapes. This is not people suing because they were not picked. This is people suing because nobody like them was picked, and as a result nobody will be in the room to make sure DOGE understands the critical perspectives they would provide,” said NSC Executive Director Kel McClanahan in a statement shared with reporters.

“Nobody disputes that there is a huge amount of wasteful spending in the federal government. Our only concern is that DOGE, as it is currently constituted, lacks the expertise to understand how its recommendations will backfire if it pushes federal workers out without understanding why they are there in the first place. Government work is not corporate work, and any recommendations made without that perspective are doomed to fail.”

The lawsuit will be filed at noon Eastern time on Monday in the U.S. District Court for the District of Columbia, and NSC plans to upload a copy of the legal filing to its Bluesky account shortly thereafter. Bluesky, a social media platform popular among liberals, has also served as a venue for NSC to voice its criticism of Trump and Musk, as well as to offer support to federal employees facing potential dismissal under Trump’s administration. For instance, NSC has publicly offered “free consultation for all feds facing the prospect of summary dismissal by Trump,” including those who worked with former Trump investigator Jack Smith.

NSC’s Bluesky account also features commentary on political issues, with McClanahan describing the “Make America Great Again” movement as “what happens if you turned being an abusive parent into a political party.” Additionally, the organization has called on President Joe Biden to pardon Jack Smith and Dr. Anthony Fauci. In one of his final acts in office, Biden granted preemptive pardons to Fauci and several others, a move that came shortly before the conclusion of his presidency.

The Department of Government Efficiency has emerged as one of the Trump administration’s key initiatives to streamline and reduce the size and spending of government entities. The project has garnered significant support from Republican members of Congress who advocate for reducing government bureaucracy. Musk, known for his leadership of companies like Tesla and SpaceX, was appointed to oversee DOGE, along with billionaire Vivek Ramaswamy.

However, reports have surfaced suggesting that Ramaswamy may step down from his role at DOGE to pursue a gubernatorial run in Ohio. The lawsuit will no doubt be a focal point in the ongoing debate over government efficiency and the role of advisory committees in shaping public policy.

U.S. Senator Rand Paul released his annual “festivus” report for 2024 which calculated a total of at least $1,008,313,329,626.12 in easily identifiable federal government waste. That’s more than a trillion dollars in waste. Some of these wasteful programs include ice-skating drag queens and a new Las Vegas Pickleball “sports” complex.
