FBI Director Nominee Kash Patel Responds to Adam Schiff’s Allegations During Confirmation Hearing

During his confirmation hearing on Thursday, Kash Patel, the nominee for FBI Director, fiercely defended himself against accusations made by Democratic California Senator Adam Schiff. The allegations centered around Patel’s involvement with a song performed by the so-called “J6 Prison Choir,” a group of individuals who were convicted for their roles in the January 6, 2021, Capitol riot.

Schiff questioned Patel’s fitness for the position of FBI Director, citing his promotion of a March 2023 song titled “Justice for All,” which featured inmates convicted for their involvement in the Capitol attack. The song, which reached No. 1 on iTunes following its release, also included a music video that Patel helped promote on Steve Bannon’s War Room. In the video, the prisoners are seen singing the National Anthem, while former President Donald Trump recites the Pledge of Allegiance.

Schiff was quick to point out that the song’s creators had been involved in violent attacks against police officers during the riot. With sharp sarcasm, he said, “Isn’t that great? People who violently attack police have a number one song thanks to you, Mr. Patel. That’s something to be really proud of.” He then pressed Patel, asking if he was aware of the violent backgrounds of the individuals involved in the choir, to which Patel firmly responded, “I did not know about the violent offenders and I did not participate in any of the violence in and around January 6.”

Patel, who was not involved in the recording of the song itself, clarified that his involvement was limited to promoting the idea of supporting families in need, not endorsing the violent actions of the rioters. He explained, “I promoted the h*ll out of” efforts to help families in distress, distancing himself from the actions of those involved in the January 6 events.

In a tense exchange, Schiff challenged Patel to face the Capitol police officers present in the room and express pride in his actions, asking, “I want you to look at them, if you have the courage to look them in the eye, Mr. Patel, and tell them you’re proud of what you did.” Schiff’s comments implied that Patel had profited from the actions of those who assaulted law enforcement officers during the Capitol breach.

Patel, visibly agitated by the accusation, responded strongly, stating, “That is an abject lie and you know it, I’ve never, never, ever accepted violence against law enforcement. I have worked with these men and women as you know my entire life, and I did not make a single dime out of this.” Patel then challenged Schiff to ask the Capitol police officers if he had their backs, emphasizing his long-standing support for law enforcement.

Throughout the exchange, Schiff maintained that an FBI director should not be associated with individuals who have committed violence against police officers and FBI agents. Patel, however, reiterated his commitment to public service, asserting that his career made him well-suited for the position of FBI Director.

The hearing also delved into other controversial topics, including Patel’s previous statements regarding the declassification of documents held at Trump’s Mar-a-Lago residence. Schiff asked Patel if he had made claims that Trump declassified certain materials before they were stored at the property. Patel confirmed that Trump had declassified “a large number” of materials, though he did not specifically confirm that all the classified documents in question had been declassified.

In addition to bringing up the “J6 Prison Choir” song, Schiff’s conduct has been a subject of controversy. In June 2023, the House of Representatives voted to censure Schiff for making false claims about having evidence of Russian collusion with Trump’s 2016 presidential campaign. This led to his removal from the House Intelligence Committee by former Speaker of the House, Kevin McCarthy, at the start of the 118th Congress in January 2023.
