The law-fare persecution against Trump is alive and well. But he may have an ace up his sleeve.
Because he just pulled a fast one in court that Democrats aren’t ready for.
Former President Donald Trump’s legal team is taking bold action, requesting that a federal court step in and take control of his New York criminal case ahead of a potential sentencing next month.
This comes after his conviction on charges of falsifying business records — a case that many see as a politically motivated attack by Democrat Manhattan District Attorney Alvin Bragg.
In a motion filed Thursday in the Southern District of New York, Trump’s team is seeking to have the case removed from Judge Juan Merchan, arguing that the former president should be granted dismissal on presidential immunity grounds.
Trump was convicted in May on 34 counts, but the legal battle is far from over.
“The ongoing proceedings will continue to cause direct and irreparable harm to President Trump—the leading candidate in the 2024 Presidential election—and voters located far beyond Manhattan,” the filing boldly asserts.
Trump’s team is pushing for “post-trial removal” to ensure that he receives a fair trial in an unbiased forum, free from what they describe as “local hostilities.”
The motion is also asking the court to block Merchan from sentencing Trump while the litigation over the removal request is still ongoing.
With sentencing currently set for September 18, the stakes are high.
Trump’s legal team isn’t backing down, also arguing that Merchan’s restrictions on Trump’s ability to speak about the case are a blatant violation of his First Amendment rights.
“The continued operation of this unlawful prior restraint is causing irreparable First Amendment harm to President Trump and the American people,” the filing states, pointing out that it’s an “inappropriate muzzle” on the leading 2024 presidential candidate while he’s on the campaign trail and potentially debating Vice President Harris.
Trump has previously sought to have the case dismissed, citing the Supreme Court’s July ruling that affirms presidents have broad immunity from prosecution.
Merchan is expected to rule on this motion on September 16, just two days before the scheduled sentencing.
If the sentencing goes forward, Trump could face up to four years in prison and a $5,000 fine for each of the 34 convictions — a prospect that his supporters see as a clear attempt to derail his presidential campaign.
Adding fuel to the fire, the filing also sheds light on Merchan’s connections to the Democratic Party, including donations to Joe Biden’s campaign and his daughter’s previous work for Kamala Harris’s 2020 presidential campaign.
This week, the House Judiciary Committee subpoenaed Authentic Campaigns, the Leftist organization that employs Merchan’s daughter, further raising questions about the impartiality of the proceedings.
Trump’s legal team is fighting back, determined to protect his rights and ensure that justice is served fairly in what they see as an unfairly biased legal battle.
