The Biden administration has agreed to a court order halting the sale of unused border wall materials, according to Texas Attorney General Ken Paxton.
This decision comes amidst ongoing tensions over border security and the future of immigration policy under the incoming Trump administration.
“We have successfully blocked the Biden Administration from disposing of any further border wall materials before President Trump takes office,” Paxton said in a statement Friday.
“This follows our major victory forcing Biden to build the wall, and we will hold his Administration accountable for illegally subverting our Nation’s border security until their very last day in power, especially where their actions are clearly motivated by a desire to thwart President-elect Trump’s immigration agenda,” he continued.
The controversy stems from allegations that the Biden administration has been quietly auctioning off unused steel slats meant for the southern border wall.
Reports surfaced earlier this month claiming the materials were being sold at bargain prices — as low as $5 — through GovPlanet, an online auction site specializing in military surplus.
Paxton and former President Trump requested a hearing in the Southern District of Texas federal court after the reports emerged, sparking concerns over the alleged removal of significant portions of the wall.
The court order now prevents the Biden administration from selling or disposing of additional materials for the next 30 days and mandates compliance with a May 2024 ruling requiring the administration to allocate funds for border wall construction.
The Texas attorney general’s office emphasized the enforceability of the court order, warning that any violations could result in severe consequences.
“If it is shown that the Biden Administration disposed of border wall materials purchased with funds subject to that injunction in violation of a court order — or that the Department of Justice made misrepresentations regarding the border materials that have been auctioned off — this would constitute unethical and sanctionable conduct, and the responsible parties could be held in contempt of court,” the office stated.
Footage obtained by The Daily Wire earlier this month added to the controversy, showing flatbed trucks hauling away steel wall sections near Tucson, Arizona, a region known for high rates of illegal crossings.
According to the footage, a Border Patrol agent estimated that about half a mile’s worth of materials was being removed daily, with plans to clear the area “by Christmas.”
The decision to auction off unused materials follows President Biden’s 2021 directive to halt construction of the border wall, a reversal of Trump-era immigration policies.
These actions have drawn sharp criticism from Trump, who last week described the sales as “almost criminal.”
“I’m asking today, Joe Biden to please stop selling the wall,” Trump said during a press conference at Mar-a-Lago. “We’re going to use that to create a strong barrier.”
“It’s very expensive, and now it’s about double the price of what it would have been six years ago, and the administration is trying to sell it for five cents on the dollar, knowing that we’re getting ready to put it up,” Trump stated.
The issue highlights the ongoing political and legal battles surrounding border security and immigration, as both the Biden and Trump administrations prepare for another shift in policy priorities. Clearly, the Biden admin has been in favor of wide open borders, while Donald Trump and his allies are insistent on closing them up for good to stop the mass influx of illegal immigrants.
