And Democrats are red with rage after Ted Cruz announced a plan to preserve the Supreme Court.
Sen. Ted Cruz Reintroduces Amendment to Cap Supreme Court at Nine Justices
As debates over the future of the Supreme Court intensify, Sen. Ted Cruz, R-TX, is once again pushing for a constitutional amendment that would permanently set the number of justices at nine. The move comes amid calls from Democrats to expand the bench.
Cruz, now backed by 15 Republican cosponsors—including Sens. Bill Cassidy (LA), Chuck Grassley (IA), Mike Crapo (ID), Thom Tillis (NC), and John Cornyn (TX)— introduced the proposed amendment previously in both 2021 and 2023.
When speaking to Fox News Digital, Cruz argued that Democrats are attempting to “use the Court to advance policy goals they can’t accomplish electorally.”
“Such a move would be a direct assault on the design of our Constitution, which is designed to ensure the Supreme Court remains a non-partisan guardian of the rule of law,” Cruz explained. “This amendment is a badly-needed check on their efforts to undermine the integrity of the Court.”
Grassley echoed Cruz’s concerns, emphasizing the importance of protecting the Court from political interference.
“Democrats’ radical court packing scheme would erase the legitimacy of the Supreme Court and destroy historic precedent,” Grassley stated. “The Court is a co-equal branch of government, and our Keep Nine Amendment will ensure that it remains independent from political pressure.”
Renewed Calls for Court Expansion
The Supreme Court currently holds a conservative supermajority, a shift that has fueled Democratic efforts to push for structural reforms. Following several high-profile rulings—including the 2022 decision to overturn Roe v. Wade—Democrats have renewed proposals to expand the Court, impose term limits, and introduce other reforms.
During a CNN town hall in October, then-Vice President Kamala Harris discussed growing concerns from Leftists over the Court’s legitimacy. When asked whether she would support increasing the number of justices from nine to 12, Harris pointed to a decline in public trust.
“There is no question that the American people increasingly are losing confidence in the Supreme Court and, in large part, because of the behavior of certain members of that court and because of certain rulings, including the Dobbs decision and taking away a precedent that had been in place for 50 years, protecting a woman’s right to make decisions about her own body,” Harris said.
“So, I do believe that there should be some kind of reform of the court, and we can study what that actually looks like.”
Similarly, Rep. Ilhan Omar, D-MN, has called for significant changes, stating in October that “We need to radically reform the broken Supreme Court.”
Legislative Efforts to Expand the Bench
Democratic lawmakers have repeatedly introduced legislation to increase the number of justices. In May 2023, Rep. Hank Johnson, D-GA, joined Sens. Ed Markey (MA), Tina Smith (MN), and Elizabeth Warren (MA), along with Reps. Jerry Nadler (NY), Cori Bush (MO), and Adam Schiff (CA), to reintroduce the Judiciary Act of 2023.
Explaining the rationale behind the bill, Johnson told Fox News Digital in October, “We want to prevent this kind of rot and decay from ever overtaking a Supreme Court again.”
But the only way the Supreme Court would rot and decay is if Leftist members of Congress succeeded in passing legislation that would pack the nation’s high court with liberal justices.
