In a resounding victory for religious liberty, the Supreme Court unanimously ruled on Thursday in favor of a Wisconsin-based Catholic charity, striking down the state’s attempt to deny unemployment tax credits to faith-based organizations.

The decision, a triumph for President Donald Trump’s judicial appointees and their commitment to protecting First Amendment rights, ensures that religious institutions like Catholic Charities Bureau are shielded from government overreach.

Court Rejects Wisconsin’s Overreach

The justices, in an opinion authored by Justice Sonia Sotomayor, declared that Wisconsin’s actions constituted an “unnecessary entanglement” with religion, violating the First Amendment’s religious clauses.

Sotomayor wrote, “When the government distinguishes among religions based on theological differences in their provision of services, it imposes a denominational preference that must satisfy the highest level of judicial scrutiny.”

She added, “There may be hard calls to make in policing that rule, but this is not one.”

The Court found that Wisconsin’s requirement for Catholic Charities to pay unemployment taxes—based on the state’s claim that the group’s work was “primarily charitable and secular”—failed to meet this rigorous standard.

The ruling reverses the Wisconsin Supreme Court’s decision and remands the case for further proceedings, as Sotomayor concluded, “Because Wisconsin has transgressed that principle without the tailoring necessary to survive such scrutiny, the judgment of the Wisconsin Supreme Court is reversed, and the case is remanded for further proceedings not inconsistent with this opinion.”

Broader Implications for Faith-Based Organizations

The Supreme Court’s decision is a pivotal moment for religious freedom, potentially paving the way for states to expand tax exemptions for faith-based organizations nationwide.

Catholic Charities Bureau had argued that Wisconsin’s ruling infringed on their constitutional protections, asserting that their work was guided by “gospel values and the moral teaching of the church.”

The state’s insistence that the group’s activities were not “operated primarily for religious purposes” because they served and employed non-Catholics was deemed unconstitutional viewpoint discrimination.
